Electronic Judicial Notifications in the Iraqi Law

The main definition of Judicial Notifications in general as stated in the Civil Procedures Law is; to enable the other party of the dispute to be aware of the dispute or a particular procedure with it, and it can also be defined as delivering the court order to the party to be notified.

Judicial notifications are an important element in the stability of the legal and judicial situation which impacts the general situation of the citizens; they are usually delivered by persons appointed by the Minister of Justice, and may also be directed by letters or telegrams in case of urgent matters; taking into consideration the importance of including all the required information in accordance with article 16 of the Civil Procedures Law no. 83 of 1969.

Judicial notifications are also considered an important part of civil litigation, as it achieves the principle of confrontation between the opponents in order to equalize opportunities between the prosecution and the defense.

The Iraqi judiciary has been keen to ensure that the notification process is made prior to proceeding with the lawsuit, and the judicial notifications were mentioned in 13 articles (13-28) of the Civil Procedures Law No. 83 of 1969, as judicial notifications are an important element of the validity of the registration of the case and are part of the public order, i.e. if one of the main conditions required to conclude a valid judicial notification according to article 16 of the Civil Procedures Law was not stipulated in it, it will be legally invalid and therefore becomes worthless.

The use of electronic methods in allowing the opponents of registering lawsuits, paying legal fees, and exchange memos in the pleas as well as many other possibilities of benefitting from the electronic methods and e-mails in legal and judicial matters, helps to achieve justice in a timely manner without delays, as judicial notifications must be speedy and accurate, which is not achieved under the use of traditional methods of conducting judicial notifications, which requires using modern methods of communication in the conduct of judicial notifications, given the speed of communication, low costs and ease of use, but the use of the said methods must be built on a legal base and regulated by the provisions of the law.

In order to activate the electronic methods in conducting judicial notifications, we believe that the Iraqi legislator should be amending the Civil Procedures Law and granting the said methods the legal authority and adopting them with explicit articles under the subject of judicial notifications, and we believe that executing this idea is doable and only needs organization, considering that many legislations in comparative judicial systems have applied these methods to overcome the delay in adjudication of cases due to illegal or inaccurate legal notifications conducted in accordance with the current traditional procedures. However, the Iraqi legislator, unfortunately, has not amended the methods of judicial notifications, and article Third (Second/E) of the Electronic Signature and Electronic Transactions Law No. 78 of 2012 stated that: The provisions of this law do not apply to the following (e. court proceedings, judicial declarations, declarations of attendance and search warrants, Arrest warrants and judicial decisions), even the recent amendment to the Civil Procedures Law no. 10 of 2016 did not consider the issue of judicial notifications.

 We see that it is necessary to amend the legal articles that lead to the delay of lawsuits and their procedures, including – amending the articles concerned with the judicial notifications under a new system to achieve flexibility in dealing with their provisions and keeping up with the developments of the modern era whenever necessary, and adopting the modern electronic methods to conducting judicial notifications, which we hope will receive support from legal specialists and responsible judicial and legal bodies.

 

التبليغات القضائية الالكترونية في القانون العراقي

يعتبر مفهوم التبليغ بشكل عام هو الوسيلة الرئيسية التي رسمها قانون المرافعات، وذلك لتمكين الطرف الآخر من النزاع العلم بالنزاع أو بإجراء معين فيه، كما يمكن تعريف التبليغ بأنه إيصال أمر المحكمة الى الطرف المطلوب تبليغه.

ويشكل موضوع التبليغات حلقة مهمة في استقرار الوضع القانوني والقضائي وما يحصل بالنتيجة من تأثير ذلك على الوضع العام في حياة المواطنين، وعادة يقوم بالتبليغ أشخاص معينين من قبل وزير العدل أو يجوز إرسال التبليغ برسالة مسجلة أو برقية في حالة الامور المستعجلة شريطة أن تحمل جميع المعلومات المطلوبة حسب المادة 16 من قانون المرافعات المدنية رقم 83 لسنة 1969.

كما تعتبر التبليغات القضائية جزءا مهما من الخصومة المدنية، فهي تحقق مبدأ المواجهة بين الخصوم من أجل تكافؤ الفرص بين الإدعاء والدفاع.

وقد حرص القضاء العراقي على التأكد من عملية التبليغ قبل الشروع في الدعوى وقد تناول القانون موضوع التبليغ في ثلاث عشرة مادة (المواد من 13-28) من قانون المرافعات المدنية رقم 83 لسنة 1969 المعدل، ذلك أن التبليغ عنصر مهم من عناصر صحة تسجيل الدعوى وهو من النظام العام، أي أن فقدان أحد شروطه الأساسية المذكورة في المادة 16 من قانون المرافعات المدنية يؤدي إلى فقدان التبليغ صحته القانونية وبالتالي يصبح لا قيمة له.

ومع إمكانية الاستفادة من استخدام الوسائل الإلكترونية في مجال تمكين المتقاضيين من تسجيل الدعاوى ودفع الرسوم ومن تبادل اللوائح القانونية قبل حلول وقت المرافعات وهناك كثير من المجالات يمكن الاستفادة من استخدام الوسائل الإلكترونية والبريد الإلكتروني في الأمور القانونية والقضائية مما يساعد على تحقيق العدالة في وقتها المناسب دون تأخير. حيث أن التبليغات القضائية لا بد أن تتسم بالسرعة والدقة، الأمر الذي لا يتحقق في ظل استعمال الوسائل التقليدية في إجراء التبليغات، ويتطلب الاستعانة بوسائل الاتصالات الحديثة في إجراء التبليغات القضائية، نظرا لما تتميز به هذه الوسائل من سرعة في الاتصال وقلة في التكاليف وسهولة استعمالها، ولكن لاستعمال هذه الوسائل في إجراء التبليغات القضائية لابد من أساس قانوني يمكن أن نستند عليه في إجراء التبليغات القضائية بهذه الوسائل.

ولكي يتم العمل بالوسائل الإلكترونية في إجراء التبليغات القضائية نرى ضرورة أن يتدخل المشرع العراقي من خلال تعديل قانون المرافعات المدنية وإعطاء هذه الوسائل الحجية القانونية واعتمادها بنص صريح في التبليغات القضائية، ونرى أن مقومات إنجاح هذه الفكرة متوفرة، وإن ما ينقص إنجاح هذه الفكرة هو التنظيم، علما بأن الكثير من التشريعات في الأنظمة القضائية المقارنة قد أخذت بهذه الوسائل لتجاوز تأخر الفصل في الدعاوى بسبب التبليغات غير القانونية أو غير الدقيقة التي تجري وفق الإجراءات التقليدية الحالية، إلا انه وللأسف فأن المشرع العراقي لم يجري تعديل طرق التبليغات القضائية، بل وقد نصت المادة الثالثة (ثانيا/ه) من قانون التوقيع الإلكتروني والمعاملات الإلكترونية رقم 78 لسنة 2012 : لا تسري أحكام هذا القانون على ما يأتي (ه . إجراءات المحاكم والإعلانات القضائية والإعلانات بالحضور وأوامر التفتيش وأوامر القبض والأحكام القضائيةحتى أن التعديل الأخير لقانون المرافعات المدنية بالقانون رقم 10 لسنة 2016 لم يتصدى إلى موضوع التبليغات القضائية.

 نرى أنه من الضروري معالجة النصوص القانونية التي تؤدي إلى تأخر الدعاوى ومنها – معالجة نصوص التبليغات بموجب نظام جديد لتحقيق مرونة أكبر في التعامل مع أحكام التبليغات ومواكبتها لتطورات العصر الحديث كلما استدعت الحاجة لذلك، وتبني مشروع الوسائل الإلكترونية الحديثة لإجراء التبليغ، وهو ما نأمل أن ينال الدعم من المختصين القانونيين والجهات القضائية والقانونية المسؤولة.
